Judicial System Greed Using Families a National Problem
County Children and Youth - State court is asked to step in
The Times Leader by Terrie Morgan-Beseckertmorgan - March 4, 2011
Attorney’s petition likens workings of county dependency court to “kids-for-cash” scandal.
An attorney who represented parents who have lost custody of their children to Luzerne County Children and Youth Services has asked the state Supreme Court to take jurisdiction over the county’s dependency court based on numerous abuses he alleges are being committed by caseworkers and others involved with the court system. Attorney James Hayward, whose license is now under suspension, said he filed a King’s Bench petition with the Supreme Court on Feb. 18, one day before his suspension took effect. Hayward said he filed the petition – an extraordinary measure that is utilized in cases alleging egregious violations – as a last-ditch effort to help his clients before he began serving the one-year suspension of his law license. “I’ll admit I made mistakes, but that doesn’t change the fact they are stealing kids,” Hayward said in an interview Thursday, referring to Children and Youth. Is Parham v. J.R., 442 US 584, 602-606 (1979) being ignored?
Excerpts from this decision:
"Our jurisprudence historically has reflected Western civilization concepts of the family as a unit with broad parental authority over minor children. Our cases have consistently followed that course; our constitutional system long ago rejected any notion that a child is “the mere creature of the State”
"Therefore, it is clear that the Court is recognizing parents as having the right to make judgments concerning their children who are not able to make sound decisions, including their need for medical care. A parent’s authority to decide what is best for the child in the areas of medical treatment cannot be diminished simply because a child disagrees. A parent’s right must be protected and not simply transferred to some state agency. " more here.

Becky,
One of the strongest proponents of Parental Consent is Congressman Ron Paul of Texas -

Becky,
For those who don't know much about Ron Paul, he is a physician, an OBGYN. He is also a big proponent of integrative (alternative) medicine, and has pushed hard to protect American's right to buy supplements, keeping them on the free market, without undue regulation.
He at one time authored a bill called the Health Freedom Act... It would have restricted the FTC from over-regulation of supplement manufacturers. It called for nothing more (and nothing less) that the burden of proof be placed on the Feds before they use strong-armed tactics to shut vitamin manufacturers down. Unfortunately, the bill never made it out of Committee.
This is not a political ad for Ron Paul...The reason I mention this, is that I'm hopeful that he might consider sponsoring legislation that would combine theses two areas (parental control rights, and the right to choose a more integrative approach with a child, rather than the current one-size-fits all approach used today).
This might also have strong support from U.S. Senator (on the Senate side) Charles Grassley of Iowa. My hope would be that Paul could draw House support, and Grassley, Senate support. Grassley has done a lot to expose Pharma, and illegal research, etc.
IMO, these rights have to be protected on a couple of sides - parental control, and also the right to opt for integrative medicine, approaches that are less intrusive, safer, and more effective - neurofeedback, hyperbaric oxygen therapy, nutrition, etc.
Actually, the Americans with Disabilities Act calls for "least restrictive" options... Another law that is being circumvented by psychiatry (not to mention the U.S. Constitution, as you poinit out often).
Hopefully, in the not-so-distant future, we will be able to get a bill passed and signed into law.
My best,
Duane Sherry, M.S.

Duane,
Thank you so much for contributing a wealth of information and insight!
There are times I feel like I have been fighting an uphill battle alone---I have been waging battle nearly 18 years; your comments remind me I am not fighting alone.
Thank you!
Becky
You're not alone, Becky.
We may be small in number, but we're large in spirit.
And we're growing larger, both in numbers and in spirit!
Duane
Duane, you Do know that Congressman Paul has been recently appointed to Chair a House Committee tasked with overseeing the Federal Reserve, right?
As I've noted till I'm blue in the face, these Mental Hygiene Parasites can Not feed themselves. They Must be Government fed, or starve. If Congressman Paul can force a Complete audit of the Fed's books it will go viral with the MSM and it's Katy Bar The Door. There go the printing presses and the Congressional Pork Checkbook, and with a return to sound money there goes Psychiatry.
D. Bunker,
You said, "With a return to sound money, there goes psychiatry."
You raise a good point.
One of the things that is rarely discussed in the debates on how to reduce the cost of healthcare is the cost of psychiatric drugs in Medicaid and to the states (by federally-mandated programs).
Billions on these drugs for children.
The fallout is horrific.
First and foremost, the damage - physical, mental, emotional on these kids.
Secondly, to the states themselves, who are left paying the bill. In some states, half the state budget is Medicaid, and at the top of the list of expenses is the cost of psychiatric drugs - for kids!
I hope Congressman can make some headway.
I hope the states and the people will make sure their voices are heard!
Duane Sherry
D Bunker,
Vera Hassner Sharav of the Alliance for Human Research Protection outlines a pretty sane approach that would help with run-away spending...
She calls on the government to stop paying for drugs that have been illegally researched... in Mediare, Medicaid, and Veterans Affairs programs -
http://www.ahrp.org/cms/content/view/695/1/
A little sanity would go a long, long way!
As far as our monetary system... We just keep borrowing money, printing money...
It goes without saying, don't ever turn the keys to your brain to a psychiatrist.
It seems like we're learning (the hard way) not to turn the keys to an economy over to the government!
Duane Sherry
Thanks Duane. I just read Vera's article & she's absolutely right. If the drug (or any other product) is adjudicated to have defrauded Govt healthcare programs by gaining entry onto the market through falsifying its trial data, actual effects, etc. it loses All Govt reimbursement.
Medicare & Medicaid are 85% of those drug sales figures, and once again, Psychiatry takes a giant hit.
Becky, please drop me an e-addy. I'm developing a research tool kit I'd like to share with you. The DOJ is simply swamped. They can't clean this up, and the drug companies can afford Every parking ticket judges hand them, but there are other laws which can be used. We can shut them down.
Duane, I'll drop you a line.
